Notice and Authorization Required for Electronic Disclosure of Protected Health Information

Pursuant to Texas Health and Safety Code, Sec. 181.154:   As part of Crozier Family Law, PLLC’s representation of clients in cases it electronically stores, receives, and transmits protected health information, therefore, Crozier Family Law, PLLC is required to post written notice to clients that client’s individual protected health information is subject to electronic disclosure.

Any electronic disclosure of a client’s protected health information to any person requires authorization from the client or the client’s legally authorized representative for each disclosure.  Said disclosure may be made in written or oral form if it is documented by Crozier Family Law, PLLC.  Provided however, the authorization is not required if the disclosure is made to another covered entity, as defined by Section 181.001, or to a covered entity, as defined by Section 602.001 of the Insurance code, for the purpose of treatment, payment, health care operations, performing an insurance or health maintenance organization function describe by Section 602.053 of the Insurance Code, or as otherwise authorized or required by Texas or Federal Law.  Additional information concerning these notice and requirements here.
